29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift. On or about August 19, 2015, at the excavation site where employees were exposed to struck-by and engulfment hazards when installing storm drainage pipes in areas where inspection of the excavation, adjacent areas and protective systems were not conducted by the competent person prior to the start of the work. The Hurtado Construction Company was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection number 891956, citation number 2, item number 1, and was affirmed as a final order on 5/23/2013, with respect to a workplace located at Richmond Subdivision - Section 7, Richmond, TX 77469.
