29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. The employer does not require the use of any form of fall protection during roofing work. This violation was most recently observed at a worksite located at 4455 Winchester Pike, Columbus Ohio, 43232. Two employees were conducting roofing work on a 2 story 8/12 pitch roof without adequate fall protection. Julio C. Galindo was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 604918, citation number 1, item number 2 and was affirmed as a final order on November 13, 2012, with respect to a workplace located at 8297Priestley Avenue, Reynoldsburg Ohio, 43068 . Julio C. Galindo was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 900356, citation number 1, item number 2 and was affirmed as a final order on June 10, 2013, with respect to a workplace located at 6643 Brixton Park Avenue Building #4, Columbus Ohio, 43235. Julio C. Galindo was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 955319, citation number 2, item number 1 and was affirmed as a final order on April 3, 2014, with respect to a workplace located at 5403-5419 Amity Moor Road, Building #3, Westerville Ohio, 43081. Pursuant to 29 C.F.R 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from the fall hazards.
