29 CFR 1926.1053(b)(6): Ladders shall be used only on stable and level surfaces unless secured to prevent accidental displacement. (a) On July 27, 2023, and at times prior, the employer does not require ladders to be placed, positioned, or secured in a stable manner during roofing work. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were using a ladder that had debris piling up around and against the side of the base and positioned on an uneven surface while performing roofing activities. To abate this violation, the employer must ensure that its employees performing roofing work are protected from hazards related to using a portable ladder and that no employee is allowed to use a ladder without ensuring it is on a stable surface free from debris possibly influencing the stability. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1630818, Citation 1, Item 2, and was affirmed as a final order on February 2, 2022, with respect to a workplace located at or near 5639 Niagara Drive in Bismarck, North Dakota.
