29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On or about Feb 21, 2020, and at times prior, for the employees exposed to trench cave in hazards while repairing utilities in a trench greater than thirteen feet in depth, in the vicinity of 407-499 North 52nd Street, Bismarck, North Dakota. (b) On or about Feb 21, 2020, and at times prior, for the employees exposed to trench cave in hazards while repairing utilities in a trench greater than nine feet in depth, in the vicinity of 350-420 66th Street SE, Bismarck, North Dakota.
