29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: Note: If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented. a. Worksite, 1155 Montauk Highway, East Patchogue. NY: An employee assigned to assemble a shed in the rear yard of the building was constructing a leading edge of the metal roof panels approximately 12 ft. above ground without being protected by the use of guardrail systems, safety net systems, or personal fall arrest systems; on or about 12/8/18. NOTE: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance to 29 CFR 1903.19.
