29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. On or about October 3, 2023, employees worked in excavation four (4) feet or more in-depth on the site's south side without a safe means of egress. On the site's south side, employees worked in an excavation that was not inspected throughout the shift for evidence of a situation that could have resulted in possible cave-ins. The on-site supervisor would have discovered that the excavation was a class "b" soil and had improper benched areas with improper slopping of the benches. If inspected by a competent person, it would have determined that a means of egress was not present in the excavation that was deeper than four (4) feet. If the inspection had been conducted per the standard, the competent person would have discovered no cave-in protection in the excavation that exceeded five (5) feet in depth.
