29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. (a) On July 27, 2023, and at times prior, the employer does not require ladders to extend three or more feet above the landing surface during roofing work. This violation was most recently observed at 406 South 11th Street in Bismarck, North Dakota where employees were using a ladder that did not extend three feet while performing roofing activities. To abate this violation, the employer must ensure that its employees performing roofing work are protected from hazards associated with the use of portable ladders and that no employee is allowed to use a ladder without ensuring it is extended three or more feet past the landing surface. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1630818, Citation 2, Item 2, and was affirmed as a final order on February 2, 2022, with respect to a workplace located at or near 5639 Niagara Drive in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1626146, Citation 1, Item 2, and was affirmed as a final order on February 1, 2023, with respect to a workplace located at or near Lot 22 Whispering Ridge in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1592324, Citation 1, Item 2, and was affirmed as a final order on June 23, 2022, with respect to a workplace located at or near 4124/4126 Silver Boulevard in Bismarck, North Dakota.
