29 CFR 1926.52(b): Employees were subjected to sound levels exceeding those listed in table D-2 of 29 CFR 1926.52 and feasible administrative or engineering controls were not utilized to reduce sound levels: a) Worksite, South Jefferson Street and I-280, Orange, NJ The employer did not implement the engineering controls to reduce noise levels for employees directed to demolish and remove concrete road surfaces with pneumatic jackhammers. The employees were exposed to noise levels exceeding those in Table D-2. While performing demolition and removal of concrete road surfaces with pneumatic jackhammers, employees were exposed to continuous noise levels at 375%, 638%, and 647% of the permissible exposure limit (PEL) 8-hour time-weighted average sound level of 90 dBA which is 1.106, 1.154, and 1.150 times the allowable exposure limit, respectively. The equivalent sound level of the measured dose is 99.53 dBA, 103.86 dBA, and 103.46 dBA. Sampling was performed for 188 minutes, 188 minutes, and 183 minutes on 09/27/2021, with the unsampled portion of time, 292 minutes, 292 minutes, and 297 minutes, respectively, considered to represent zero for the exposure calculation. Violation occurred on or about September 27, 2021 The Power Concrete Co., Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.52(b), which was contained in OSHA inspection number 1283871, citation number 1, item number 5a and was affirmed as a final order on 7-5-18, with respect to a workplace located at Port Reading Avenue between ProLogis Way and West Avenue in Woodbridge Township, NJ.
