29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): a) At the site, on October 8, 2014, the employer did not provide for cave in protection for an employee observed preforming preparation work for the installation for force and reclaim sewage lines in the north east section of an excavation that measured five feet in depth with a spoil pile that measured three feet in height, that was located directly at the edge of the excavation for a total depth of eight feet, exposing the employee the hazards associated with death, broken bones, lacerations, and bruises.
