29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) in a safe and timely manner when necessary means where taken to assure safe operation. On or about 6/10/14, at the Koch Foods Gainesville facility, employees were exposed to inhalation and death by hazards in the Ammonia refrigeration machinery room and surrounding areas as the employer did not ensure deficiencies in Ammonia refrigeration equipment was corrected as soon as possible. The following deficiencies existed: 1  Piping insulation is damaged and in need of repair 2  Exhaust louvers are hinged louvers and not the fail open type 3  Oil Pots 2 and 3 relief valves have reducer bushings in the outlet side of the equipment In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
