29 CFR 1910.178(p)(1): Powered industrial truck(s) in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s). On or about March 31, 2014, and times prior thereto, employees were operating a Daewoo forklift with the following deficiencies: a) back-up light inoperable b) front light missing/inoperable c) front, right tire severely damaged d) hydraulic leak Employees were exposed to caught-in/caught-between hazards and/or fire hazards in the event the forklift was to malfunction. Atwoods was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard 29 CFR 1910.178(p)(1), which was contained in OSHA inspection number 312805062, citation number 1, item number 2, and was affirmed as a final order on January 12, 2010, with respect to a workplace located at 6235 N. Broadway St., Park City, Kansas 67219.
