29 CFR 1904.39(b)(1): Employer did not report a fatality or multiple hospitalization incident using the 800 number within 8 hours of discovery: a) The employer failed to report a fatality to either the Boise Area Office during office hours or the OSHA 800 number after hours. The incident occurred at approximately 11:30 a.m. on Tuesday February 11, 2014, and the employer learned of it at approximately 11:55 when he reported it to the Heyburn police dispatcher. OSHA contacted the employer after learning of the incident from a media release on February 13, 2014 at 10:15 a.m., almost 48 hours later. Note: Abatement certification is NOT required for this item.
