Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which were free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees are exposed to crushing and thrown from the loader if operator lost control. a) The articulating Trojan 1500 front end loader is used without properly functioning brakes. ABATEMENT NOTE: One feasible and acceptable abatement method would be to fix the brakes to make them operational and to ensure that employees do not operate motorized vehicles and equipment without properly functioning brakes.ning
