29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used. Crossbraces were used as a means of access. a) On April 21, 2025, employees were not provided with a proper/safe means of access and egress while performing chimney repair work from a tubular welded frame scaffold. Joseph Birkenheier Tuckpointing and Masonry, Inc. was previously cited for a violation of this occupational safety and health standard 1926.451(e)(1), which was contained in OSHA inspection number 1675293, citation number 1, item number 2 and was affirmed as a final order on October 3, 2023, with respect to a workplace located at 1601 Highland Ave., Wilmette, IL 60091. Joseph Birkenheier Tuckpointing and Masonry, Inc. was previously cited for a violation of this occupational safety and health standard 1926.451(e)(1), which was contained in OSHA inspection number 1770342, citation number 1, item number 2 and was affirmed as a final order on November 26, 2024, with respect to a workplace located at 834 16th Street, Wilmette, IL 60091. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
