29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition. On or about October 15, 2024, in the Northwest section of the warehouse a defective forklift was utilized by the employees. Polygroup North America was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1444531, citation number 1, item number 5a and was affirmed as a final order on February 24, 2020, with respect to a workplace located at 9033 Billy the Kid, El Paso, Texas 79907.
