29 CFR 1926.503(a)(1): The employer does not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) The employer is failing to provide fall protection training to employees. Employees work on customer roofs on a daily basis tearing off and installing gutters, heat tape, and other roof accessories. The employer sends new employees to work in the field without any safety orientation or training. On or about 7/8/2024, and at times prior, this practice led to the employer not protecting employees while installing heat cable onto a customer's house located at 29108 Kinnikinnick LN Evergreen, CO, from exposure to fall hazards in excess of 6 feet. An employee fell approximately 19.7 feet and died as a result of exposure to fall hazards while not utilizing fall protection. The employee and the rest of the crew had not been trained in fall protection or fall hazards by a competent person. To abate this violation, the employer must come into compliance with this standard at all of its job sites to ensure employees engaged in residential construction activities above six feet are utilizing a fall protection system before roofing and gutter activities begin and are trained to do so.
