29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access: The employer is failing to protect employees from elevated fall hazards. The condition was most recently observed on or about November 2, 2023, when five employees were observed working on a roof at 215 Brookstone Creek Drive in Wentzville, Missouri. The employer did not ensure that where portable ladders were used for access to an upper landing surface, and where the ladder's length allowed, the ladder's side rails were extended at least 3 feet (.9m) above the upper landing surface being accessed. The ladder the employees used to access the roof was extended approximately 10 inches beyond the upper landing, or edge of the roof, thus exposing employees to fall hazards. H R Vasquez, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard (name previously cited standard), which was contained in OSHA inspection number 1607793, citation number 1, item number 2 and was affirmed as a final order on December 23, 2022, with respect to a workplace located at 1633 Kehrs Mill Road, Chesterfield, Missouri.
