29 CFR 1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. Jobsite rear: The ladder, used by employees to access the roof, was too short to extend 3-ft beyond the roof surface and was not secured at the top. Employees were exposed to tipping/falling over 12-feet while mounting and dismounting the ladder. The employer routinely fails to assure effective protection against tipping and/or falls as required by the standard, as demonstrated on September 7, 2023, when employees were using a ladder to access the roof of the residence at 24 Wyoming Rd. Newton, MA 02460 which was too short and unsecured and exposed to falls of over 12-feet to the ground. Obdulio Palma DBA Palma Contracting was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.1053(b)(1), which was contained in OSHA inspection number 1420550, citation number 1, item number 2 and was affirmed as a final order on January 17, 2020, with respect to a workplace located at 226-232 Oliver St., Malden, MA 02148.
