29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Jobsite first floor deck 17 Fayerweather St. N. Billerica, MA: a) The employer did not ensure that employees, engaged in the wood framing of interior and exterior walls, were protected from fall hazards greater than 6-feet from open sides and edges by guardrails, safety nets or personal fall arrest systems. b) The employer did not ensure that employees, engaged in the wood framing of interior and exterior walls, were protected from fall hazards greater than 9-feet through open floor holes by guardrails, safety nets or personal fall arrest systems. c) The employer did not ensure that employees, engaged in the wood framing of interior and exterior walls, were protected from fall hazards greater than 8-feet through unguarded window openings by guardrails, safety nets or personal fall arrest systems. The employer routinely fails to assure effective protection against fall hazards as required by the standard, as demonstrated on or about August 22, 2023, when employees were not protected from fall hazards where fall protection was not utilized at the site at 17 Fayerweather St. N. Billerica, MA 01862. NL General Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1427338, citation number 2, item number 1 and was affirmed as a final order on October 3, 2019, with respect to a workplace located at 3 Cedarwood Ln., Burlington, MA. NL General Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1400470, citation number 2, item number 1 and was affirmed as a final order on October 3, 2019, with respect to a workplace located at 3 Lexington St., Burlington, MA. NL General Construction Corp was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 11398577, citation number 1, item number 1 and was affirmed as a final order on November 27, 2019, with respect to a workplace located at 3 Lexington St., Burlington, MA.
