29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c). On or about April 13, 2023, employees were exposed to a cave in hazard while performing sewer line replacement at a residential home located at 277 Beck Ave., Akron, Ohio 44312. An employee was working in a 7 foot 4 inch deep trench and the employer did not ensure cave in protection was used. Downs Drain & Septic Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard (29 CFR 1926.652(a)(1), which was contained in OSHA inspection number 1587148, citation number 1, item number 3, and was affirmed as a final order on 5/13/22, with respect to a workplace located at 193 Sand Run, Akron, Ohio 44313.
