29 CFR 1917.50(c)(5)(iv): All cargo handling gear having SWL greater than 5 short tons was not proof load tested every 4 years according to Table A of 29 CFR 1917.50 by a designated person or a person accredited by OSHA in accordance with part 1919 of this chapter. (a) Follansbee Cleaning Fleet, Barge MEM 2442, 54 Landry Lane, Follansbee, WV: On March 22, 2023 and times prior, an employee worked in proximity to a Liebherr R953B Litronic excavator with a clamshell attachment during barge cleanout activities. The employer did not ensure that the excavator and clamshell attachment were load tested every 4 years.
