29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. a. Located at the site at 665 Royal Pines - Lot 6663, Delaware, Ohio: On or about January 9, 2023, the employer did not ensure that employees were protected from falls while engaged in residential construction activities and framing in the second story of the house with unprotected edges, thereby exposed to falls of up to approximately 11 feet. Jos� Luis Barcenas Flores was previously cited for a Repeat-Serious violation for this Occupational Safety and Health standard, which was contained in OSHA inspection number 1498729, citation number 2, item number 4 and was affirmed as final order on March 9, 2021, with respect to a workplace located at Lot 13489, Newark, OH, 430553. Jos� Luis Barcenas Flores was previously cited for a Repeat-Serious violation for this Occupational Safety and Health standard, which was contained in OSHA inspection number 1474231, citation number 2, item number 1 and was affirmed as final order on June 16, 2020, with respect to a workplace located at 1743 Silver Lawn Drive, Lot#114, Grove City, OH, 43123.
