29 CFR 1926.451(g)(1)(vii):For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) The employer does not require employees to use any form of personal fall arrest systems or the use of guardrail systems while performing stucco activities from a supported tubular welded scaffold. This violation was observed at 1348 Bainbridge St., Philadelphia, PA 19147 on December 13, 2022, where employees performing work on the scaffold on multiple levels were not protected from fall hazards of approximately 19.5 feet by the use of a fall protection system. To abate this ongoing violation, the employer must provide and require the use of personal fall arrest systems or guardrail systems while employees are utilizing the working levels of the scaffold.
