29 CFR 1926.451(e)(1): When scaffold platforms were more than 2-feet (0.6m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface were not used: (a) This violation occurred on or about November 29, 2022, at a job site located at 342 Water Ridge Drive, Lavon, TX; where employees working from a two-tier scaffold system applying bricks to a single-family house and did not have a safe means of access, were exposed to fall hazards of approximately 14-feet to the lower level. MIGUEL VALDIVIA WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD 1926.451(B)(1) OR ITS EQUIVALENT WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1556987, CITATION NUMBER 1, ITEM 5, THAT WAS ISSUED ON OCOTOBER 22, 2021 WITH RESPECT TO A WORKPLACE LOCATED AT 5413 BASHAM LANE, DENTON, TX, 75207. THE FINAL ORDER DATE WAS NOVEMBER 17, 2021.
