29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels are not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a) The employer David Troyer Construction LTD does not protect each employee from fall hazards while performing roofing activities by the used of guard rail systems, safety net systems, and or personal fall arrest systems. This most recently occurred on November 1, 2022, during the installation of a new residential roof at location 20585 Bristol Dr. Lakeside Marblehead OH, 43440. Employees were exposed to the hazard of falling approximately 11ft - 22 ft to the ground below with the use of personal fall protection system or an alternative fall protection method. David Troyer Construction LTD was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1549704, citation number 1, item number 3 and was affirmed as a final order on November 1, 2021, with respect to a workplace located at 151 Dunway Ave North Canton, OH 44720. David Troyer Construction LTD was previously cited for a violation of this Occupational Safety and Health Standard 1926.501(b)(13), which was contained in OSHA inspection number 1456535, citation number 1, item number 2 and was affirmed as a final order on October 10, 2020, with respect to a workplace located at 7670 Strausser St. NW North Canton, OH 44720.
