29 CFR 1926.1053(b)(1): Where portable ladders were used for access to upper landing surfaces, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladders were used to gain access: a) On October 26, 2022 at a residential construction site located at 5639 Niagara Drive Bismarck, ND employees were allowed to continually use a ladder that did not extend three or more feet above the landing surface while installing roofing shingles. Note: This company was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA Inspection Number 1592324, Citation 2, Item 1, and was affirmed as a final order on June 23, 2022, with respect to a workplace located at 4124/4126 Silver Boulevard in Bismarck, North Dakota.
