29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. This employer continues to fail to ensure employees are protected from falls while framing the roof of a new build residential home. The most recent incident of such failure occurred on or before July 20, 2022, at a worksite located at 134 Chapman Drive, Lot 324, Pataskala, Ohio 43062: the employer failed to ensure that an employee was protected from falls while conducting framing work on the roof of a new build residential home. The employee was exposed to a fall distance of 20 feet to the ground level. Clarence M. Brigner III was previously cited for a Willful violation of this Occupational Safety and Health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1544329, citation number 1, item number 2 and was affirmed as a final order on 9/28/2021, with respect to a workplace located at 115 Beaman Gates Drive, Lot 273, Pataskala, Ohio 43062.
