29 CFR 1926.102(a)(1): The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. Guilsen lima dba Extreme Roofing and Siding LLC does not ensure that employees use appropriate eye protection while engaged in residential roofing activities. This violation was most recently observed, on or about 07/07/2022 and 7/9/2022, at 43-48 Hearthstone Court, Upper Saddle River, NJ/Roof where employees #1, #2, and #4 were exposed to eye loss/eye injuries from flying objects, while using a Metabo pneumatic nail gun to install roof shingles. Pursuant to 29 CFR 1926.19, within 30 days, the employer must submit documents describing the steps it is taking to ensure compliance, including a description of the type of eye protection provided and the steps taken to enforce use of appropriate eye protection where employees are exposed to possible danger of eye injuries.
