29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At the fabrication shop located at 1138-1 Pondella Road Cape Coral, Florida: On or about October 19, 2022, the employer did not ensure that employees that were provided and required to use disposable filtering facepiece respirators such as Lot Fancy - N95, while performing cut and fabrication work, were medically evaluated before the use of the respirator in the workplace.
