29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: (a) Jobsite located at 3515 Midvale Avenue Philadelphia, PA, 19129: The employer did not ensure that an excavation deeper than 5 feet was inspected by a competent person for protective systems and other hazardous conditions. Employees were exposed to soil collapse hazards while removing stones out of an excavation with depths measuring approximately 11.5 feet. Condition noted on or about August 27, 2021. Real Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(k)(1) which was contained in OSHA inspection number 1348513, citation number 1, item number 2, and was affirmed as a final order on March 30, 2020, with respect to a workplace located at 2010 Walnut Street, Philadelphia PA 19102.
