29 CFR 1910.146(d)(9): The employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and/or for preventing unauthorized entry: (a) On or about 5/4/2021, and at times back to 1/6/2021 - Fuel House - Upper (a.k.a. Tee Pee), employees entering the silo were exposed to hazardous energy and engulfment hazards due to the accumulation of sawdust and adequate measures such as, but not limited to the employer not identifying the Rescue and Emergency Services or how to contact the Rescue and Emergency Services for entries dated between 1/6/2021 to 5/4/2021. Lewis Brothers Lumber Company, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.146(d)(9), which was contained in OSHA inspection number 1434934, citation number 1, item number 3 and was affirmed as a final order on 4/15/2020, with respect to a workplace located at 1031 13th Street NW, Aliceville, AL 35442.
