29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition: a) Warehouse Area (Facility - Mobile, AL): On or about August 28, 2020, and times prior, the employer failed to take out of service a Hyster Fork Truck: Model - S50FT and required employees to perform forklift operations with damaged tires; exposing employees to struck-by and crushed-by hazards during forklift operations. The Express Courier International, Inc. DBA (Doing Business As) LSO Final Mile was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.178(p)(1), which was contained in OSHA inspection number 1232504, citation number 1, item number 1 and was affirmed as a final order on 08/01/2017, with respect to a workplace located at 240 Oxmoor Court, Suite 244, Birmingham, AL 35209.
