29 CFR 1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section. a. On or about March 12, 2020, located at The Courtyards At River Bluff at 6652 South Section Line Delaware, Ohio, an employee was performing pipe work in an excavated trench that had a trench shield. The ends of the trench shield were left open with one end having unprotected 10 foot vertical excavated wall, thereby exposing the employee to a cave-in hazard. Nickolas Savko & Sons, Inc. was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA inspection number 1390732, citation number 2, item number 1 and was affirmed as a final order on June 18, 2019, with respect to a workplace located at 3889 Shannon Drive Canal Winchester, Ohio. Savko & Sons, Inc. was previously cited for a violation of this Occupational Safety and Health standard which was contained in OSHA inspection number 1059864, citation number 1, item number 2, and was affirmed as final order on July 1, 2015, with respect to a workplace located at Main Street/Keswick in New Albany, Ohio.
