29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). The employer does not ensure that employees are trained and evaluated to operate powered industrial trucks. This violation was most recently observed on October 7, 2019, when the employer did not ensure that powered industrial truck operators were trained and evaluated to operate the CAT TL 943 Rough Terrain Forklift and Clark Model CCS15 LP powered forklifts as required. MODS International Inc. was previously cited for a violation of this occupational safety and health standard which was contained in OSHA inspection 1218539, citation number one, item number three, and was affirmed as final order on October 5, 2017, with respect to a workplace located at 5523 W.
