29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section: (a) On October 4th, 2019 for employees exposed to cave in hazards while replacing a waterline up to eight feet deep in a trench with near vertical walls, located in the vicinity of 12th Avenue NW & Custer Drive in Mandan, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1335635, Citation 2, Item 1b, and was affirmed as a final order on November 21th, 2018, with respect to a workplace located in the vicinity of 503 North Fourth Street in Bismarck, North Dakota. Note: This company was previously cited for a violation of this Occupational Safety and Health standard or its equivalent standard which was contained in OSHA Inspection Number 1317076 ,Citation 2, Item 1b, and was affirmed as a final order on September 11, 2018, with respect to a workplace located at located near the intersection of North Washington Street & Interstate Avenue in Bismarck, North Dakota.
