29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) 1004 Coleman Street-Wilmington, DE: On or about May 15, 2019, the employer did not ensure that individuals working from an unapproved and unsecured work platform on a JCB Rough Terrain Telescoping Forklift, Model SH320, were protected from fall hazards. Employees of a subcontractor were working from an unapproved and unsecured work platform constructed of stacked plywood while engaged in residential construction activities at heights of approximately 12 to 15 feet above grade without any means of fall protection. b) 1004 Coleman Street-Wilmington, DE: On or about June 27, 2019, the employer did not ensure that individuals working from an unapproved and unsecured work platform on a JCB Rough Terrain Telescoping Forklift, Model SH320, were protected from fall hazards.
