29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note: As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated: a) At 8764 Rand Ave, Buildings 1 Belforest Apartments, Daphne, Alabama: On or about April 30, 2019 and at times prior; the controlling employer allowed subcontracted employees working for Socios Atlanta Construction to perform siding activities without fall protection while working from an aerial lift exposing these employees to a fall hazard of 11.4 feet to the ground below. b) At 8764 Rand Ave, Buildings 4 Belforest Apartments, Daphne, Alabama: On or about April 30, 2019 and at times prior; the controlling employer allowed subcontracted employees working for Guzman Remodeling to perform framing activities without fall protection while working from an aerial lift exposing these employees to a fall hazard of 18 feet to the ground below. THE GARCIA BUILDING CO., LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.453(B)(2)(V) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1330027, CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON JANUARY 2, 2019, WITH RESPECT TO A WORKPLACE LOCATED AT 985 PLANT ST., MACON, GEORGIA.
