29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Entire Facility. The employer did not develop, implement and maintain a written chemical hazard communication program incorporating program components such as a list of all hazardous chemicals in the workplace, labels and other forms of warning, safety data sheets (SDS) and employee information and training. Specifically, the employer did not conduct and certify hazard communication training for employees adding water to powered industrial truck batteries containing acid, and did not maintain a SDS for the battery acid. Abatement certification is required for this item in accordance with 29 CFR 1903.19(c).
