29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i): a. On or about December 4, 2018 at the jobsite list above - an employee performing water main tapping operations was in a trench measuring ten (10) feet seven (7) inches in depth; sixteen (16) feet in length; and eight (8) feet in width that was not provided with cave in protection. Millennium Contracting Co. was previously cited for a violation of this Occupational Safety and Health Standard 1926.652(a)(1) which was contained in OSHA inspection number 1262491, citation number 1, item number 1 and was affirmed as a final order on December 27, 2017, with respect to a workplace located at 43rd and Indiana Avenue, Chicago, IL 60653.
