29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or was required to use the respirator in the workplace: ColorCoat, Inc./Middlesex, NJ- Throughout the Plant Area: Employees who were required to wear tight fitting, air purifying respirators during spray painting operations were not provided with medical evaluation to determine their ability to safety use respiratory protection. Respirators used on a daily basis included: a) 3M (9105 VFlex) N95 filtering face piece respirator b) 3M elastomeric, half face respirator with organic cartridges Condition observed on or about February 25, 2016. The ColorCoat, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.134(e)(1), which was contained in OSHA inspection number 1245158, citation number 1, item number 3a, and was affirmed as a final order on 9/12/2017, with respect to a workplace located at 294 North Industrial Park Rd, Milton, PA 17847.
