29 CFR 1910.146(c)(4): When the employer decided that his employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: a) Production area Ribbon Blender: On or before August 9, 2017, and at times prior, the employer exposed employees to potential atmospheric, chemical, caught-in and struck-by hazards in that the employer did not develop and implement a written permit-required confined space program before employees entered the ribbon blender, to include but not limited to, training, isolating the electrical energy for the ribbon blender (lockout), testing of the atmosphere, providing equipment for communication and safe ingress/egress, issuing of an entry permit, designation of entrants, attendants, and entry supervisor, and implementation of rescue and emergency services. The date of last entry was 8/4/2017. b) Production area Cone Mixer: On or before August 9, 2017, and at times prior, the employer exposed employees to potential atmospheric, chemical, caught-in and struck-by hazards in that the employer did not develop and implement a written permit-required confined space program regarding the cone mixer, to include but not limited to, training, isolating the electrical energy for the cone mixer (lockout), providing equipment for communication and safe ingress/egress, issuing of an entry permit, designation of entrants, attendants, and entry supervisor, and implementation of rescue and emergency services.
