29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At the Feed Mill, on or about and at times prior to November 29, 2016, the employer failed to provide a medical evaluation for an employee that wore a tight fitting respirator (half face respirator) while mixing ingredients for the mixer/scale and during cleaning operations, exposing the employee to a respiratory hazard.
