29 CFR 1910.38(b): An emergency action plan is not in writing, kept in the workplace, and available to employees for review: Location: Facility This violation was observed on November 28th, 2106, when employees were exposed to fire hazards and other hazardous emergency conditions due to the lack of a written emergency action plan. Fire extinguishers were available, but employees were not trained on how to use them. To abate this violation, the employer must write an emergency action plan, in accordance with 29 CFR 1910.38(b). Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance.
