29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Each employee engaged in sheathing activities with unprotected sides and edges, is not protected from falling by the use of fall protection system(s). New Homes Construction, Inc. does not ensure the use of fall protection while doing sheathing work. This violation was most recently observed at Block 14802, Lot 89, 6 Mimosa Court, Sicklerville NJ where employees were exposed to fall hazards, in excess of 11 feet to the ground surface below, when walking/working from pitched roofs of a residential structure without the use of any fall protection. This condition was noted on or about 10/06/16. To abate this violation the employer must ensure that its employees performing sheathing installation, and other related activities, are protected from falls and that no employee is allowed to be exposed to a fall hazard of 6 feet or more without the use of adequate fall protection. Pursuant to 29 CFR 1903.19, New Homes Construction, Inc. must submit documents describing the steps it is taking to ensure compliance, including a description of how these steps protect its employees from fall hazards. New Homes Construction, Inc. was previously cited for a Repeat violation of this Occupational Safety & Health Standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 1040582, Citation Number 2, Item Number 1 and was confirmed as a final order on 05/31/16, with respect to a workplace located at 12 Montclaire Road, Lot 19, Medford NJ. New Homes Construction, Inc. was previously cited for a Repeat violation of this Occupational Safety & Health Standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA Inspection Number 638798, Citation Number 2, Item Number 1 and was confirmed as a final order on 05/13/13, with respect to a workplace located at 16 Westbury Drive, Winslow NJ.
