29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): 29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): a) On or about September 16, 2016, the employer provided employees with a Terex TH844C rough terrain forklift without ensuring they were competent to operate the equipment safely, as demonstrated by successful completion of forklift training and evaluation. Polo Masonry Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.602(d) which was contained in OSHA inspection number 1001826, citation 2, item 1, and was affirmed final order on January 28, 2015, with respect to a workplace located at 2829 N. Leavitt, Chicago, IL 60647. Polo Masonry Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.602(d) which was contained in OSHA inspection number 108513, citation 1, item 1, and was affirmed final order on December 13, 2011, with respect to a workplace located at 3634 W. Montrose Ave., Chicago, IL 60618. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
