29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: The employer does not protect employees engaged in residential roofing operations 6 feet (1.8 m) or more above lower levels. As a result, the employer is exposing employees to the hazard of falling. The lack of fall protection was most recently observed on May 18th, 2016 at the jobsite of a new construction project located next to 136 Oakshire East, Glen Carbon, IL. The employees conducting residential roofing operations are exposed to the hazard of falling approximately thirteen (13) feet. Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance, including an explanation of how these steps protect its employees from fall hazards. The employer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) under inspection 1116328, citation 2, item 1, issued on 03/25/16 and was affirmed as a final order on 04/18/16 with respect to the worksite located 2138 Tuscany ridge court, Maryville, Illinois
