29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) On or about September 1, 2015, during plaster masonry activities the employer did not ensure employees working from a fabricated frame type scaffold were protected from falling by a guardrail, personal fall arrest, or other fall protection system. The top work level were employees were working was approximately 24 feet above the ground. It contained no guardrails. The second level were employees were working was approximately 16 feet above the ground. It did not contain guardrails. b) On or about September 1, 2015, during plaster masonry activities the employer did not ensure employees working from a wooden plank supported by the scaffold system and building itself were protected from falling by a guardrail, personal fall arrest, or other fall protection system.
