29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety: On or about 4/3/15, the competent person on-site did not remove an employee from a trench with a depth of approximately 6'5" deep that did not have adequate sloping for trench protection and was not provided an acceptable form of egress. L&H Gyr Excavating, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.651(k)(2) which was contained in OSHA inspection number 107318, citation number 2, item number 1 and was affirmed as a final order on 3/21/12, with respect to a workplace located at Martin Ave. Fond Du Lac, WI 54937.
