29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: a) Employer did not provide a competent person to conduct inspections where employees were exposed to the hazards associated with trenching and excavation work. Aqua City Plumbing and Sewer, Inc., was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.651(k)(1), which was contained in OSHA inspection number 192131, citation number 1, item number 5 and was affirmed as a final order on May 3, 2012, with respect to a workplace located at 2851 W. Greenleaf Ave., Chicago, IL 60645. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
