Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Employees are exposed to being struck by falling debris and weak liquor at Unit #1 Tar Tank Storage Area, #2 Weak Liquor Tank. The bottom flange (floor plate) of this tank rusted away; the roof plates are flexible deflecting down underfoot; the tank top walkway support bents and deteriorated; the base wing plates and lower gusset plate for the diagonal bracing angles are rusted thin and away. A feasible and useful means of abatement, among other methods, is to repair the tank in accordance with sound engineering practices.
